Purpose and Reason:

The Department of Revenue’s Division of Motor Vehicles proposes to amend the existing regulations to update the certification standards to reflect the newly adopted federal standards set forth in new Model Specifications for Breath Alcohol Ignition Interlock Devices (BAIIDs), National Highway Traffic Safety Administration, Federal Register Vol. 78, No. 89 published on May 8, 2013. The amended regulations also include reporting requirements that are already in place but had not been included in the prior regulations. Finally, the amended regulations contain new sections defining administrative and criminal interlock penalties, conditional hardship license and the procedures to be utilized when eligible motorists wish to remove the interlock restriction.
